Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Awebo Digital ("we", "us", "our"). By subscribing to or purchasing any of our services, you agree to be bound by these Terms.

1. Services

Awebo Digital provides software development services through two models:

• Monthly Subscription: Ongoing software development delivered on a recurring monthly basis. You may submit unlimited requests; we work through them one at a time.
• MVP Build: A one-time, fixed-price engagement to design and build a minimum viable product, delivered within the agreed timeline.

2. Subscription & Billing

Monthly subscriptions are billed in 30-day cycles. You will be charged at the start of each cycle. You may pause or cancel your subscription at any time. If you pause mid-cycle, your remaining days are preserved and resume when you unpause.

MVP Build projects require payment according to the schedule agreed upon during scoping (typically a deposit upfront with the remainder due upon delivery).

3. Scope of Work

For monthly subscriptions, requests are handled one at a time in the order submitted. We reserve the right to estimate timelines and communicate if a request requires more time than usual.

For MVP Build projects, the scope is defined and agreed upon before development begins. Any work outside the agreed scope will require a separate agreement.

4. Revisions

Monthly subscription plans include unlimited revisions on delivered work. MVP Build projects include revisions within the agreed scope. Post-delivery bug fixes are included for 30 days after launch.

5. Intellectual Property

Upon full payment, you own 100% of the source code, designs, assets, and intellectual property created for your project. We retain no rights to your deliverables. We may reference the general nature of the work in our portfolio unless you request otherwise in writing.

6. Confidentiality

We treat all client information, business logic, and project details as confidential. We will not share your proprietary information with third parties without your written consent.

7. What We Don't Cover

Our services do not include:

• DevOps infrastructure management or server administration
• Native iOS/Android application development
• AI/ML model training or data science
• Third-party service costs (hosting, domains, APIs, etc.)

8. Client Responsibilities

You agree to provide timely feedback, access to necessary accounts or systems, and any content or assets required for us to complete your requests. Delays caused by lack of client input may affect delivery timelines.

9. Refunds

Monthly subscriptions are non-refundable for the current billing cycle but you may cancel at any time to prevent future charges. MVP Build deposits are non-refundable once development has begun. If we fail to deliver the agreed scope, we will work with you to reach a fair resolution.

10. Limitation of Liability

Awebo Digital's total liability for any claim arising from our services shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data.

11. Termination

Either party may terminate the engagement at any time. Upon termination, we will deliver all completed work and source code to you. Any outstanding payments for work already completed remain due.

12. Changes to Terms

We may update these Terms from time to time. We will notify active clients of any material changes. Continued use of our services after changes constitutes acceptance of the updated Terms.
